On September 17, 2020 Gov. Newsom signed SB 1383 which can now be found in California Government Code Section 12945.2, et seq.

If you are a CA employer with 5 or more employees in any industry, this new law applies to you.

It became effective on January 1, 2021 and it requires that you update your Employee Handbook, train your managers, and administer this leave correctly because it is a mandated leave with a number of rules that, if not followed, will increase the potential for litigation like nothing we have seen before for small employers.

If you have 50 or more employees, you have been offering CFRA along with FMLA for years. But the new CFRA is different than the “old” CFRA in some very important ways. Also, for employers with 20 or more employees, the New Parent Leave Act no longer exists so if you have a policy in your handbook offering it, your handbook needs to be updated eliminating it and adding CFRA.

The reasons for taking the 12 weeks of leave are the following:

  1. An employee’s own serious illness or injury
  2. To care for a family member who is ill or injured
  3. To bond with a new baby, adopted child or foster child
  4. Military exigencies (please call us for more on this subject)
